As most of you already know, a Federal Lawsuit has been filed under the fair Labor Standards Act in the District Court here in Charlotte on behalf of all current and former CMC Nurses and Nursing assistants seeking to collect unpaid wages.

The claims stem from CMC’s former policy of automatically deducting 30 minutes of wages for lunch each work day without verifying whether its nurses and nursing assistants had actually received an uninterrupted 30 minute lunch period.

Now, CMC has begun to institute several new policy and procedure changes presumably aimed at addressing this litigation, assuring compliance with the Fair Labor Standards Act and at averting further claims. We applaud the effort.


WHAT ARE WE ASKING FOR

The Plaintiffs are asking CMC to repay all of them and all of you these 30 minute lunch periods for each day they and you worked at CMC over the past 3 years. There is a 2 year statute of limitations which may be extended to 3 years if the Court finds CMC’s actions were willful.


WHAT YOU NEED TO DO

In order to benefit from this litigation you must Consent or “Opt-In” to participate as a member of the potential collective class action. This class has not yet been certified but if and when it is certified, you will not be a member unless and until you “opt-in.”

For all of you who have not yet consented or “opted-in” to this litigation, the clock is still running against you. We can only seek recovery of wages going back for a maximum of 3 years. Each day that passes, therefore, represents potential lost wages that we can no longer seek to recover on your behalf. The limitations period stops for each collective class member only when that individual “opts-in.”
